All correspondence received by 12 September 2005 was included in a report to Durham County Council’s Cabinet where the decision was made to consult on the re-organisation.

Following receipt of the responses from the above consultation, Durham County Council’s Cabinet gave approval on 20 September 2005 to publish a statutory notice outlining the intention to re-organise Durham Johnston Comprehensive School into a single site comprehensive school on the premises of the Crossgate Moor Site from 1 September 2008.

The statutory notice was placed in the Durham Advertiser on 22 October 2005. The date for receipt of responses was 1 December 2005.
The Government introduced new legislation on 1 September 2006, where the Local Authority, when establishing a new secondary school, must either invite proposals to tender for building (competition) for such a school or apply to the Secretary of State for consent to publish proposals without running a competition. Durham County Council, therefore, placed an advert inviting tenders on 16 June 2006. Pre-qualification on the competition for the building of new secondary schools on 1 September, 2006
